Nederland adopts 2024 International Codes after removing ‘emergency’ language

The Nederland Board of Trustees voted June 16 to adopt Ordinance 891, incorporating the 2024 editions of the International Code Council (ICC) codes, with trustees removing emergency-adoption language from the ordinance and accepting a standard 30‑day effective period.
Planning staff explained that the 2024 ICC updates cover the International Building Code, Residential Code, Mechanical, Plumbing, Fuel Gas, Energy Conservation, Property Maintenance, Existing Building, and related fire and safety codes. "The town of Nederland currently utilizes adopted versions of the international code to regulate construction, development, fire and life safety, energy efficiency and property maintenance standards," staff Brit told the board, noting the state requires municipalities to adopt the 2024 energy code by July 1, 2026.
Trustees debated whether to declare the ordinance an emergency measure — which would make the code enforceable immediately — or adopt it now without the emergency clause (which would make it effective 30 days after publication). Staff explained options including calling a special meeting to secure a supermajority for emergency adoption if the board desired immediate enforcement; staff also noted little immediate permit activity was anticipated in the short enforcement gap.
The board amended the ordinance to remove the emergency declaration from the title and body and approved the revised ordinance. Voting trustees recorded affirmative votes; Trustee Billy Giblin was recorded as having lost connection before the vote and did not participate.
What happens next: staff will publish the ordinance and implement training and outreach for local builders and reviewers; staff said they will work with SafeBuilt and local contractors to update guidance and web materials.
