Yutan council adopts resolutions, appoints police chief and tables audit

The Mayor and City Council of Yutan voted on several formal actions at the Feb. 17 meeting, adopting multiple resolutions, approving administrative corrections to the floodplain code and tabling the fiscal year 2024–25 audit for further review.
Resolutions adopted - Resolution 2026-1: The council approved appointing Terry Luthy II as Chief of Police (motion by Council President Schimenti, second by Councilmember Lawton). Vote: Schimenti, Mach, Smith and Lawton — yes; motion carried. - Resolution 2026-2: The council approved participation in a Mutual Finance Organization (motion by Councilmember Lawton, second by Councilmember Mach). Vote: unanimous. - Resolution 2026-3: Because two taxing entities were not notified during a new blight study, the council voted to de-blight the current redevelopment area before proceeding with the new blight study (motion by Councilmember Smith, second by Council President Schimenti). Vote: unanimous. - Resolution 2026-4: The council authorized the treasurer to invest and automatically renew surplus municipal funds, including certificates of deposit (motion by Councilmember Lawton, second by Councilmember Mach). Vote: unanimous.
Audit and floodplain code The auditor presented the FY24–25 audit and answered questions about bond and CD totals and a CRA creation date; Administrator Oliva said some figures appeared incorrect and the auditor (Lindsay Anderson of Ortmeier CPA PC) said the items came from prior accountants and would be corrected. Council President Schimenti moved to table acceptance of the FY24–25 audit for additional review; the motion carried unanimously.
Community Planner Scott Costa (recorded as Community Planner Costa) reported two state-identified errors in the adopted model floodplain code related to recreational vehicles and variance criteria. The council approved a letter for the mayor to sign interpreting the code administratively while staff drafts an ordinance amendment to fix the model-code errors.
What the council did not decide The council did not adopt a final ordinance on utility rates at this meeting (the second reading passed, and final adoption remains pending). The audit was tabled rather than accepted, and staff were instructed to draft code amendments for the floodplain corrections.
