The Yutan City Council on Jan. 20 approved Ordinance 818, a floodplain-management code combining state and federal minimums to maintain the city's participation in the National Floodplain Insurance Program (NFIP).
Community Planner Costa told the council the ordinance reflects state and federal requirements. He explained one substantive change: if a property owner declines to pursue a professional determination of base flood elevation, the ordinance sets a default requirement of three feet above natural grade (previously two feet in the city's zoning text). Costa also said the draft includes civil violations and that many Nebraska communities use a $100-per-day penalty; that figure is included in the proposed ordinance.
Mayor Thompson opened the public hearing at 7:22 p.m.; no members of the public spoke. Councilmember Smith moved to approve the first reading of Ordinance 818 and to waive the next two readings; Schimenti seconded the motion. The roll call vote was Mach, Smith, Lawton and Schimenti — unanimous in favor — and the council carried the motion.
Why it matters: The ordinance sets local standards that align with state and federal floodplain management requirements and preserves the city's eligibility for federal flood insurance programs. The raised default elevation (from two to three feet above natural grade when no engineered flood elevation is provided) increases a minimum building standard for properties in unmeasured floodplain areas.
