Council approves special‑use permit for auto body shop at 1416 North Missouri with air‑quality condition

The West Memphis City Council voted to approve a special‑use permit allowing an auto body and paint shop at 1416 North Missouri Street, authorizing the use in a Connecting Corridor (CC) zoning district and adding environmental and use restrictions.

City Attorney Stevenson introduced the third reading of the ordinance, noting the permit would allow an auto body and paint operation at the listed address. Councilor Monday moved and the council approved an amendment requiring that the new business provide documentation to planning and development that it will be in compliance with the National Emission Standards for Hazardous Air Pollutants (referred to in the meeting as the “6H rule”) and any applicable requirements of the Arkansas Department of Environmental Quality. Councilor Monday also moved, and the council approved, a related amendment prohibiting the property from being converted to a car lot in the future.

The chair then called for a vote on the ordinance as amended; the motion passed and the clerk assigned the ordinance number 2716. The amendments were described on the floor as conditions to be added to the ordinance before it is signed by the mayor.

The ordinance will be filed with the city clerk’s office after the city attorney incorporates the approved amendments. The council’s action allows the owner to operate an auto body and paint shop under the amended terms; any required permits from state environmental authorities remain separate and are the responsibility of the business to secure.

The council moved on to other business after the vote.
