The Select Board on Sept. 9 approved a request from Charm's LLC to operate a mobile food truck at the Tony Kent parking lot (8 South Gages Way, South Dennis) Monday–Friday with extended hours of 11 a.m.–5 p.m. The applicant said the later window better serves landscapers, town employees and families returning home after work; the truck had previously been restricted to four‑hour on-site limits under the Select Board's hawker-and-peddler policy.
Board members and staff discussed jurisdictional overlap: the Select Board can set vendor hours under the hawker/peddler regulations but the Board of Health and building/planning may need to review permitting, food-safety and any de facto land-use impacts if the vendor remains on-site for multiple days. The Board of Health appeared at the meeting and said it would review operational health standards at its own hearing; the building commissioner warned that if an operation becomes effectively permanent on a property, a planning/zoning review could be triggered.
The Select Board approved the 11 a.m.–5 p.m. weekday permission on a case‑by‑case basis (motion recorded with one abstention) and asked staff to confirm any Board of Health and planning/building referrals as needed. The vote preserves the board's ability to set different hours at other sites on a case‑by‑case basis.
