Board approves front-porch setback variance for 594 Bone Steel Street

Jack Bramstead told the board he has lived at 594 Bone Steel Street for roughly 28 years and that a contractor’s measurements produced a larger (8x8 ft, 64 sq ft) replacement porch that encroaches on the front-yard setback. Bramstead said the previous porch’s ledger board had rotted and the contractor replaced the ledger and framing, which resulted in the larger dimension.
Board members examined whether the porch moved closer to the right-of-way; on review they found the new porch aligns with the pre-existing porch location and does not increase encroachment toward the street. Bramstead said he has no plans to enclose the porch and that removing or reconfiguring it to meet the current code would be a financial hardship.
Citing the five statutory factors in New York Town Law §267-b, the board found the evidence met the variance standard, classified the action as a Type II SEQR action requiring no further environmental review, and approved the area variances with the condition that the applicant obtain all necessary permits.
The board’s recorded motion and vote were unanimous among members present; the minutes will include the formal findings of fact and resolution language.
