Council accepts Plan Commission's unfavorable recommendation, halting Westlyn rezoning petition

The Plainfield Town Council voted unanimously to accept the Plan Commission's unfavorable recommendation on the Westlyn rezoning petition, a move council staff said will terminate the current application and allow the applicant to begin the process again.

Town Attorney Mr. Daniel told the council that because the Plan Commission had already held a public hearing and certified its recommendation to the council, the petitioner could not simply withdraw the rezoning request. "Since it has been acted on by the Plan Commission, had a public hearing by the Plan Commission, and certified to the town, I don't believe that can be withdrawn at this point," he said, adding that accepting the Plan Commission's recommendation is the practical way to let the applicant "start over."

Councilmember Dan Bridget moved to accept the Plan Commission's recommendation; the motion was seconded and approved on a roll-call vote with all five council members voting yes. The council record shows no substitute motions or amendments to the Plan Commission's recommendation.

Why it matters: Accepting the unfavorable recommendation ends the current rezoning petition, meaning the developer or landowner would need to refile with the Plan Commission if it seeks rezoning again. The council noted that the Plan Commission could consider waiving certain timing rules if the applicant requests to restart the process.
