The Town of Newburgh Planning Board voted April 16 to ask its attorney to prepare a referral to the Zoning Board of Appeals for the 609 International Boulevard site plan after staff identified a rear yard setback variance and other outstanding technical items.
Michael A. Morgante (Arden Consulting Engineers) updated the Board on revisions to the FedEx truck repair facility plan, including DOT stage two entrance permitting, wetlands validation and updated landscaping, lighting and access plans. Code Compliance Officer Jim Campbell requested clearer documentation of handicapped parking and signage, fire sprinkler requirements, limits on outdoor storage and the plan for garbage disposal. Campbell also cited code limits on vehicle storage and spacing.
Town consultant Pat Hines said the project limits of disturbance are shown as 0.79 acres and should be protected, that the project will require Orange County referral, and that bulk table corrections and a rear yard setback variance may be necessary. Board members pressed the applicant for clarity on vehicle sizes (Morgante said vehicles would be about 22–28 feet), how vehicles awaiting repair would be handled and how employee parking would be provided.
Attorney Dominic Cordisco and the Board agreed that a ZBA referral letter should be prepared to cover the rear yard setback and any other variances that might be required; the motion passed unanimously (mover John A. Ward; second Cliff Browne). Staff also noted the project must post bonds and satisfy consultant comments prior to final site plan signature.
Next steps: Planning attorney to prepare ZBA referral; applicant to correct bulk tables and respond to consultant comments; staff will circulate to Orange County Planning as appropriate and the Board will determine lead agency and SEQRA circulation once outstanding items are resolved.
