Board declares intent to be lead agency for MSM TR subdivision; staff list technical requirements

The Town of Newburgh Planning Board voted Feb. 19 to declare its intent to act as lead agency for environmental review of the subdivision of lands of MSM TR on Chapel Road and to circulate that intent to involved agencies under SEQRA.
Applicant representative Ryan Smithem described the site as approximately 6.25 acres on the east side of Chapel Road and said the proposal would include multiple new dwellings served by individual septic and water services; lots one and two were proposed to share a common driveway and lots three and four a separate shared drive. Smithem said a tree survey and preservation plan would be submitted and that a dedication document for driveway access was forthcoming.
Town consultant Pat Hines reviewed additional requirements: submittal of a tree survey, highway superintendent signoff on driveway locations, shared‑driveway maintenance agreements, confirmation of lot areas where highway dedications exist, stormwater pollution prevention plans and DEC permit coverage where required, and Orange County Health Department approval for septic systems. Hines also said adjoiners’ notices must be mailed and recommended the Board circulate for lead‑agency status because other agencies are involved.
One discrepancy in the record: Smithem described four proposed dwellings, while Hines later referenced a five‑lot subdivision in his comments. The Board moved to declare intent for lead agency (motion by Cliff Browne; second by John Ward) and the roll call vote was unanimous.
What happens next: the Board will circulate its intent to other involved agencies, the applicant will supply required documentation (tree survey, driveway dedication/legal documents, stormwater and septic approvals), and the Board will consider further action after agency responses and technical signoffs.
