Zoning board approves addition for Herrmann Avenue homeowner

The Town of Newburgh Zoning Board of Appeals approved Feb. 26 a set of area variances allowing homeowner Dean Zambito to build a 15-by-20 side-yard family-room addition at 23 Herrmann Avenue.
Contractor Will Hernandez, representing Zambito, described a modest addition that would not increase neighborhood detriment. Board members noted the lot’s small size and existing preexisting nonconforming conditions — particularly an existing garage — and ran through the five-factor area-variance test. Counsel reminded the board that self-created hardship is relevant but not dispositive; ultimately the board concluded the application met the standards for relief.
Mr. James Eberhart moved to approve the variances; Mr. Gregory Hermance seconded and the roll call was unanimous. The board granted the variances and wished the owner luck as he proceeds with building permits.
