Staff noted the town code permits outdoor amplified sound until 11 p.m. in the applicable zone, and that the code includes decibel-based commercial-noise thresholds. Councilors asked whether the town would proactively monitor sound levels or rely on complaints; staff said the town has some sound-monitoring capability within departments and will respond to complaints. Fire and life-safety occupancy limits had not yet been reviewed by the fire authority; staff said the application arrived shortly before the packet deadline and they pushed the item into the consent agenda to support local business but could pull it for more information.
Councilors also asked about tax delinquencies and prior uses of the space; staff said Raquel's had leased the space previously and that tax obligations are written into the lease as conditions. "We can work through those questions; it's akin to what we were discussing earlier with a parklet situation," a staff member said. The council did not take a final vote in the work session and asked staff to obtain occupancy and fire-review details if councilors want to treat the item in the regular meeting rather than consent.
