Mount Kisco board authorizes outside counsel to review Fourth Amendment questions; alcohol hearing continued to Sept. 15

Trustee Thomas G. Luzio asked the Village Attorney to examine whether enforcement provisions in a proposed local law implicate Fourth Amendment search‑and‑seizure concerns, particularly in areas such as Kirby Plaza. Village Counsel Dan Pozin said he had no immediate answer on that constitutional question and noted that concealed-container matters are governed by State law. Deputy Mayor Theresa Flora raised a deed restriction for Leonard Park and asked how enforcement would operate there. Trustee Karen B. Schleimer urged expanding the local law to cover vaping, smoking and other drugs in public parks.

After discussion, the board authorized the Village Manager to engage outside counsel to review potential constitutional issues related to enforcement in public spaces. The motion passed with Mayor J. Michael Cindrich, Deputy Mayor Flora and Trustee Angie Guerra voting in favor; Trustee Thomas G. Luzio abstained; Trustee Karen B. Schleimer voted no. The authorization directs staff to obtain external legal review to clarify whether the proposed enforcement provisions are consistent with constitutional protections.

Separately, the board voted to adjourn the public hearing on amendments to Chapter 43 (Alcoholic Beverages) to a date‑certain meeting on Monday, Sept. 15, 2025, so the board can further consider legal questions and edits. The continued hearing provides time for counsel review and additional public input.
