The Lincoln County Board of Commissioners approved a planning recommendation to allow a family transfer that will split 15.13 acres from a 16.85-acre parcel in the Coutney Ridge subdivision, transferring that portion from Daniel Green to his wife under state family-transfer provisions.
Planning staff (presenting the request from Breen Ridge Surveying) recommended approval with conditions carried forward from the subdivision’s original approval: the survey must meet ARMS standards, taxes must be paid, a licensed title abstractor must certify owners of record and any liens, and written consent from owners and lien holders must be on file. Staff also noted DEQ approval will be needed for both parcels to address sanitation and stormwater issues.
Several public comments and a written letter from neighbors (the Warers) raised concerns about noise, air quality, junk vehicles and road maintenance tied to an existing mechanic business on the property. Commissioners acknowledged those concerns but explained that the family-transfer statute and the area’s lack of zoning restrict the commissioners’ ability to impose additional conditions; existing covenants and state statutes governing nuisances would continue to apply. Staff said they would check whether the subdivision’s covenants were properly recorded with the clerk and recorder and would follow up with Daniel Green in writing.
A motion to recommend approval of the amended plat passed by voice vote; the transcript records at least one commissioner saying "opposed" during the voice vote but does not provide a numeric roll-call. Daniel Green, who participated online, thanked the board and confirmed awareness of septic and related DEQ requirements.
The approval is subject to the stated conditions and to any subsequent DEQ approvals required for the parcels’ sanitation/stormwater needs. Staff will issue a confirmation letter to the applicant outlining conditions and next steps.
