Commissioners voted on June 9 to permit use of a family-transfer exemption for a 15.13-acre portion of lot two in Courtney Ridge subdivision to allow Daniel Green to transfer that land to Olivia Green. Planning staff and the subdivision-review committee recommended denial, citing a quitclaim conveyance followed by attempted use of the family-transfer exemption and the county's rebuttable-presumption rules for transfers inside platted subdivisions.
Planning staff explained the committee's concerns and recommended denial under Lincoln County subdivision regulations, noting that in platted subdivisions a family transfer is subject to additional scrutiny and DEQ approval prior to lot creation. Staff suggested a mortgage survey as an alternative approach for the applicant if a lender required a separate parcel.
The owner, speaking at the podium, said they had explored lending options locally and were told lenders required separation of the shop parcel for financing. The owner said they believed recent DEQ approvals for the site had been submitted as part of commercial-building updates and that separating the parcels was a lender recommendation.
A commissioner said he was "really concerned about doing a motion like this" and the precedent of sidestepping subdivision regulations, but the board discussed conditions tied to platted-subdivision family transfers (notice to neighbors, DEQ approval, and other required conditions). The board made a motion to allow the family-transfer exemption process to proceed administratively with required conditions and to return the specific approval action with those conditions.
The board took a voice vote; the motion passed with recorded opposition. Staff said they would prepare the item for a subsequent meeting with conditions and next steps for final administrative or board action.
The board's action allows the Green family to pursue the family-transfer pathway under county rules for platted subdivisions but does not itself record a new parcel; DEQ approvals and any other conditions must be satisfied before a new lot could be created.
