A council member told colleagues that the state legislature recently changed rules to make economic-development portions of executive sessions confidential and that unauthorized disclosures could be a misdemeanor.
"All parts of economic development requests in executive session are now confidential. All of it. Period," the council member said, adding that the village is working on a liability waiver drafted by Bricker & Graydon that applicants would sign as part of the application process to protect the village from inadvertent disclosures.
The speaker said Bricker & Graydon proposed a waiver that would release the village from liability for inadvertent disclosures while preserving criminal penalties for willful, unauthorized disclosures. The speaker said they had discussed implementation with colleagues, including Jimmy, John and Christie, and that one practical issue was whether the village had an application process through which the waiver could be collected.
Council members and staff will coordinate with the mayor and counsel to craft the waiver and the process for obtaining signatures; no formal vote was recorded on the waiver during the session. The announcement followed the council's earlier business and preceded adjournment.
