Council to notify homeowner after planning and zoning flags out-of-compliance shed; sidewalks repairs discussed with CVSSD

At the July 3 meeting, the Cleveland Town Council discussed a planning-and-zoning referral about an accessory building that appears out of compliance with local setback and building-permit requirements and agreed to notify the homeowner.

Planning and zoning reported that the shed in question sits too close to the house and may be on or closer than the property line, potentially violating accessory-building setbacks. Council members noted the town's enforcement role and whether planning and zoning can send a notice or if the council must authorize enforcement. "The letter tells you what the ordinance you're violating is, how long you have to fix it, and if you don't fix it by this date, you're going to accrue a fine," a committee member said, noting the town used a lawyer's template.

Council consensus was to send an informational notice citing the ordinance and to add enforcement options (including fines) to next month's agenda if the matter is not resolved. Members also proposed broader outreach to residents explaining building-permit requirements.

Separately, the council discussed sidewalk projects with the Castle Valley Special Service District (CVSSD). Members described multiple sunken or raised sidewalks across town and asked staff and council members to compile a list of specific addresses for repair or replacement and to confirm whether CVSSD can perform lift-and-level repairs or if full replacement is needed.

Next steps: staff will prepare and send the planning-and-zoning letter, compile addresses of damaged sidewalks for CVSSD review, and place enforcement options on the next council agenda if the shed is not addressed.
