Patrick Clifford told the board that the property is a registered vacation rental and that, under the municipal code, three administrative citations in a single 12‑month period require suspension of the certificate for two years. Code compliance officer Jesse Grialva testified that on May 1, 2026 he responded to a disturbance report and observed music audible beyond the property line; he said he identified the song using a department‑issued phone with the Shazam app, made on‑site contact with the responsible guest (Brian), who admitted playing the music, and issued citation A121. Grialva noted the property had two prior music citations (July 17, 2025 and Sept. 7, 2025) that were paid or appealed as reflected in the record.
Owner Dr. Sagan acknowledged responsibility for guest conduct, said guests complied promptly when notified, and described preventive steps taken after the incidents, including installing sound detection devices, updating listing language to specify a no‑music policy and adding direct messaging to guests reiterating the rule. Board members noted the municipal code imposes strict liability for repeated violations; without evidence discrediting the citations the board voted to uphold the two‑year suspension and related resolution by a 5‑0 vote. Staff told the owner the suspension does not prevent long‑term rentals and that city staff will follow up regarding compliance and next steps.
