Irvington schedules public hearing for 76 North Broadway and attorney outlines legal uncertainty

The resolution cited sections 224‑47.9D4B and 224‑47.9F6B as the zoning provisions under which the board will consider the application and directed the village clerk to publish notice as required by law.
At the meeting the village attorney briefed trustees on a recent state law change that can exempt certain projects from environmental review. He said the planning board found the 76 North Broadway project exempt under that change and also — as a precaution — issued a negative declaration in the event the exemption is set aside. The attorney reported a lawsuit has been filed challenging the exemption and said whether the project remains exempt could hinge on whether more than 20% of the project is non‑residential.
"You're going to have to do that when you make a decision on the bonus," the attorney told trustees, referring to a board resolution that would include a finding about the exemption when the board later considers developer bonuses.
The board’s scheduling of the public hearing formally notifies residents of the July 20 session at Village Hall, where the project will be discussed and public comment accepted.
