Plain City adopts mobile-vendor zoning ordinance with emergency clause after safety and permitting discussion

On April 28 the Plain City Council approved Ordinance 13-2025, which adds Chapter 1194 to the planning and zoning code to regulate mobile vendors in the Village. The measure passed on second reading with an emergency clause so permit issuance can begin without delay.

Councilmembers asked staff technical questions before the vote. Village Planner Derek Hutchinson told Council that similar zoning provisions exist in nearby communities. At issue were whether mobile vendors could draw electric from adjacent permanent structures and whether vendors could continue to operate on properties surfaced with gravel. Hutchinson said connecting cords can create tripping hazards and could present fire-code concerns; he also explained that parcels with gravel are grandfathered under current rules but would need to meet code if substantial improvements are made to the site.

Mr. Lewis moved to approve Ordinance 13-2025 and declare an emergency; Mr. Harriman seconded. The motion passed unanimously, and staff noted the ordinance supersedes the prior moratorium on mobile vendors. The code creates at least two permit types, including a seasonal permit that can apply to a property for multiple operating dates; variance requests remain available for property owners in special circumstances.

Next steps: With the emergency declaration in place, the Village may begin issuing mobile-vendor permits under the new rules; staff will return with any recommended clarifications or implementation procedures as needed.
