Plain City extends mobile vendor moratorium by emergency ordinance, schedules fee and signage next steps

Planner Derek Hutchinson reminded council that a temporary moratorium on permitting and issuing mobile vendor licenses was adopted Dec. 9, 2024. He said the Planning and Zoning Commission has recommended a zoning code change to address permitting for mobile vendors operating on private property; vendors that operate in the public right-of-way would still be governed by Chapter 735 of the Codified Ordinances administered by the Police Department. Justin Dreier, the Clerk of Council, said the proposed moratorium extension would last one year but would automatically lift once the implementing legislation is adopted. Councilmembers said they would consider approving the zoning change at the April 14 meeting to allow vendors time to get permits before the summer season.
Hutchinson also presented a draft Planning and Zoning fee schedule that would remove many fees from the Codified Ordinances and place them in an external fee schedule document that the Village would review and approve as needed; the Planning and Zoning Commission recommended the change and a public hearing was scheduled for May 12, 2025.
Village Administrator Haley Lupton described earlier Uptown plaza plans that had included a gateway arch over a pedestrian alley next to Lovejoy Plaza. Local property owner Tim Dawson asked whether the Village would partner to install an arch, proposing that it be named "Smucker Alley" in honor of the late Ralph Smucker. Council discussed cost, placement and naming policy; President M. Terry and other members expressed support for the Smucker name and asked staff to obtain quotes for one sign at the south alley entrance and for two signs (south and north). Mayor Jody Carney requested that an item be added to the April 14 meeting agenda to honor Ralph Smucker as a former councilmember.
