The Zoning Commission unanimously voted on June 24 to recommend denial of a rezoning and specific-use request that would have allowed auto paint and body repair with partially exposed outside storage at 12139 Jones Malzburger Road.
Staff told the commission that while the property currently has a certificate of occupancy for auto repair, the proposed expansion to include paint and body operations and outdoor storage is inconsistent with the community commercial land-use designation and introduces potentially hazardous emissions and more intensive activity adjacent to single-family uses. The staff report noted the site’s 34-foot, 11-inch setback was insufficient to buffer the residential neighborhood from potential hazardous emissions.
Applicant representative Fernando Ramirez said the owner intends to install a paint booth and has shown neighbors and inspectors the proposed controls; he said inspectors regularly check equipment and that modern booths use extractors and filters to capture fumes. Ramirez also said some neighbors who initially objected had visited the site and rescinded opposition after meeting inspectors.
Commissioners asked about emissions controls, setbacks and the history of nonconforming uses on the property; staff reiterated the land-use plan inconsistency and public-health concerns. The commission voted to recommend denial; the matter will proceed to City Council as a recommendation by the commission.
