Commissioners and staff, however, reported that a paint booth had been present intermittently in recent years and that TCEQ/state setbacks and city inspection requirements apply. One commissioner noted the proposed paint chamber addition would be 55 feet from the nearest property line.
Neighbors and public commenters raised emissions, fumes and proximity to residences as core concerns. Staff said the property had mixed, sometimes nonconforming, uses and that prior operations complicated the review. Several commissioners said they were uncomfortable approving the request without clearer neighborhood consensus and evidence that emissions and setback requirements would be met.
After discussion the commission moved to deny the rezoning; the motion carried by roll call. The denial is a recommendation to the city council.
