The Basalt Planning & Zoning Commission voted unanimously June 16 to approve a PUD amendment allowing a modest first‑floor addition at 739 Hillrest Drive intended to make a single‑family home accessible for a wheelchair‑bound family member.
Applicant Glenn Joerger presented medical justification for a 605 sq ft first‑floor bedroom and bathroom and argued decommissioning upstairs space would be more costly and less functional. James (staff) said the town attorney's memo and HUD/DOJ guidance require the commission to weigh whether the requested accommodation would undermine legitimate zoning purposes, the benefit to the individual, and whether less‑burdensome alternatives exist. Staff had suggested decommissioning approximately 470 sq ft upstairs as one alternative but acknowledged the accommodation could be reasonable under the Fair Housing Act.
Commission discussion focused on precedent and enforceability; staff and the town attorney's memo emphasized that FHA accommodations are evaluated on a case‑by‑case basis and do not automatically create a binding precedent for other properties. Commissioners asked administrative questions about setbacks, ramps and building permit requirements. Commissioners also confirmed conditions in the staff memo would be included, including administrative recordation of the PUD amendment and compliance with standard building, tree removal and fire‑protection requirements.
PNZ recorded the approval with the administrative conditions described by staff and directed that the PUD control document be amended and recorded to reflect the granted accommodation. The applicant may proceed with permit submittals consistent with the recorded amendment.
What happens next: the applicant will record the PUD amendment in the public record and pursue building permits; standard inspections and code compliance remain required.
