Lincoln County commissioners granted preliminary plat approval Jan. 7 for a two-lot subdivision in the Dicky Lake area owned by Montana Lake Getaway LLC (representative Thomas Sibson absent). Staff said the parcel has been productive hay ground, contains several water rights on Dicky Creek, and is generally level and treeless.
The recommendation included a 50-foot no-build buffer along Dicky Creek because of active agricultural use and to protect the stream. Staff reiterated the newly required DNRC groundwater notice (Form 602i) language where applicable and asked applicants to transfer and designate existing water rights to the subdivided parcels. Conditions also included a DEQ sanitation form and living-with-wildlife covenant language.
Commissioners discussed local utility access, emergency services proximity and the transfer of water rights; they voted to approve the preliminary plat with the 19 listed conditions and tasked staff with ensuring required paperwork — including water-right transfers and DEQ forms — is completed prior to final approval.
