Staff: new district fire code supersedes earlier local decking ordinance; local amendment would need council action

Committee members asked whether a previous local ordinance governing decking materials remained in effect after the district and town adopted an updated fire code.
Darcy, speaking for staff, explained that the fire protection district adopted the updated fire code and the town ratified the district’s code earlier this year. "The district adopts the fire code and then our council has the opportunity to adopt it as is or adopt it and make changes," Darcy said, adding that prior local decking language based on older code cycles was likely superseded by the newer code. Darcy said adopting local amendments would require a town-council ordinance, staff time for analysis, and a review of cost and process implications.
Rebecca noted that municipal-code updates can lag in the town’s online code repository, so older language may still appear on the website until the municipal code is fully refreshed. Committee members agreed to have staff double-check the town code and the district ordinance to confirm whether the old decking ordinance was superseded and whether any targeted amendments are feasible.
No formal motion was taken on code amendments during the meeting.
