Council members voted unanimously June 16 to approve several interrelated resolutions to enable Phase 2 of the Heyday Oak Creek development.
City staff explained the package includes a land swap under the city’s tree‑preservation ordinance that shifts acreage between the city and developer CR Oak Creek Land 2 LLC. According to staff, the city currently owns about 12 acres, will retain roughly 6.4 acres, and will gain about 10.2 acres as part of the final certified survey map; the CSM will preserve the corner at 27th and Putes for the city. The staff presenter described the swap as not strictly equal in acreage but intended to preserve key parcels for public use and tree‑preservation compliance.
Assistant City Administrator and City Engineer Matt Sullivan discussed the companion legal instruments: an amended access easement, a water‑main easement, and the infrastructure development agreement that covers the public water main for the project. Sullivan said the development agreement ‘‘really only covers the water main’’ and that storm sewer and sanitary work will be private obligations of the developer. He told the council the developer’s team and counsel had been cooperative in negotiating terms that protect the city’s interests.
Councilors moved and adopted the following resolutions by roll call: a resolution approving special warranty deeds between CR Oak Creek Land 2 LLC and the city (Res. 12694‑061626); a resolution approving an amendment to an access easement agreement (Res. 12695‑061626); approval of a water main easement (Res. 12696‑061626); and approval of the Heyday Oak Creek Phase 2 infrastructure development agreement (Res. 12697‑061626). Each motion passed on a recorded roll call vote.
Why it matters: The package lays the legal groundwork for the developer to complete Phase 2 while securing the city’s retention of a key corner lot and ensuring the water main will be constructed as public infrastructure. The presentations noted the city will continue to negotiate storm water maintenance and related items in subsequent actions.
