The Muskego Common Council voted unanimously June 16 to disallow a citizen's defamation claim tied to a Facebook post, a move that reduces the statute of limitations for any lawsuit to six months.
Jeff, a city staff member speaking to the council, said the city's insurer, Statewide Services, investigated the claim and did not find city liability. "At this time, we're asking it to be disallowed," Jeff said, explaining that disallowance accelerates resolution and shortens the period in which the claimant may file suit from a three-year statute to six months.
Alderperson Schrader asked for specifics about the underlying allegation; Jeff said it involved a publication on Facebook. The council conducted a roll-call vote after confirming that "yes" would mean denying the claim. Alderperson Wolf, Alderperson Hamill, Alderperson Bellows, Alderperson Brace, Alderperson Schrader, Alderperson Dilgie and Alderperson Madden all voted yes; the motion passed seven in favor.
No further details about the substance of the alleged publication or the claimant's identity were provided in open session.
