Commission issues OOC with conditions for 29 Lewis Bay house relocation; patio must be pervious

The Conservation Commission on March 5, 2026 issued an order of conditions (OOC) for a proposal to relocate and elevate a dwelling at 29 Lewis Bay Boulevard, Unit 6, after the applicant submitted revised plans addressing earlier concerns.
Dan Ojala of Down Cape Engineering told the commission the revisions previously requested were made and that the new location for the house was adjusted because of a view easement. Commissioner Tierney pressed for details on the procedure to move the structure and expressed concerns about soil settling; Ojala detailed the method and said the soils are stable.
The revised plan locates a proposed patio roughly 17 feet from the coastal bank and at about 17 by 20 feet in size. Commissioners required that the patio be dry set so it remains pervious; the commission also asked that future plan revisions and responses be clearly documented in plan comments. The CA suggested adding a special condition requiring approval of a landscape plan before work proceeds.
Commissioner Frost moved to issue an OOC with special conditions, including approval of a landscape plan; the motion was seconded by Commissioner Bower and carried 6-0. The OOC includes special conditions to protect resource area functions and requires a landscaping plan to be submitted for approval before construction.
