The Colfax City Council approved an amendment to the municipal code that removes a separate regulatory distinction between small and large community care facilities in residential zones.
Kathy Peas, the planning consultant, told the council that the change responds to the city’s 2021 housing element and state review and that the city attorney concurred that the housing element requires implementing the zoning change. Peas explained that state law limits local regulation of facilities with six or fewer residents unless the local housing element includes a specific provision and that the proposed ordinance removes the small/large distinction accordingly.
Council members discussed the potential local impact and noted the city can re-evaluate the ordinance if demand increases or if broader general-plan changes are pursued. The council voted to approve the amendment and directed staff to schedule the second reading and implementation timeline.
The ordinance will take effect 30 days after second reading, per the usual municipal code process.
