The Town Board adopted a local law on June 16 requiring modern central air‑conditioning systems to be located at least five feet from side or rear property lines in the town’s zoning districts.
Bill (board member) explained the measure was prompted by an increase in variance applications to the Board of Appeals: "of the 80 applications for variances before the board of appeals, 23 would involve setbacks for central air conditioning systems," he said, and noted that the appeals board almost uniformly grants these variances. The proposed local law would make the setback requirement explicit and reduce the number of administrative variance hearings.
The board opened the public hearing and, with no members of the public offering comments during the hearing, moved to close the hearing and adopt the local law. The motion to adopt was moved, seconded and passed by voice vote; the supervisor declared, "The law passes." The board recorded the procedural motions to open and close the hearing prior to adoption.
The local law language as presented requires a five‑foot setback from side or rear yards regardless of other district setback requirements; staff said it is intended to reflect changes in modern HVAC equipment and simplify the variance process.
