Inland Wetlands Commission says POCD tasks may be outside its jurisdiction; pledges to provide input

During the Jan. 11 Bolton Planning & Zoning Commission meeting, three Inland Wetlands Commission representatives raised jurisdictional concerns about several tasks listed in the town’s Plan of Conservation & Development (POCD).
Jim Loersch, Ross Lally and Barbara Kelly told the PZC that some POCD tasks identified as to be led by the IWC appeared to fall outside the commission’s statutory authority and therefore could not be carried out by the IWC alone. The PZC responded that it had not intended to ask the IWC to act beyond legal limits but rather to offer technical input and influence on matters where wetland expertise is relevant. The IWC representatives said they were willing to assist “where possible and appropriate” and agreed to keep communication channels open between the two commissions.
Director of Community Development Patrice Carson attended the exchange and facilitated distribution of background materials. The discussion clarified the boundary between advisory input and regulatory authority as the town works to implement portions of the POCD that touch on wetland resources and permitting.
No formal action or change to the POCD was adopted at the meeting; the exchange was recorded as an inter‑agency coordination discussion and may inform future staff work on implementation.
