Council approves capital-plan updates, SRF loan authorization and contingency engagement for 3M/DuPont settlements; waives privilege on identified letters

At the meeting, the Lake Placid Town Council approved a package of ordinances, resolutions and other actions.
Ordinance 2026-03 (annual updates to the capital improvement schedule) was approved on second reading after staff noted the addition of a natural gas line and removal of dog-park wording. The roll-call vote was recorded as yes by Council member Ziad, Council member Hayes, Council member Eberhart and Council member Royce; the motion passed.
Resolution 2026-05, updating the town's 10-year capital financial strategy and related support documents for the 2030 comprehensive plan technical document, was moved and adopted by roll call.
The council adopted Resolution 2026-06 to designate the office of the mayor as the town's authorized representative for final SRF loan disbursement and closeout for project WW28022, enabling the mayor to sign required loan-closeout documents.
On a separate matter, public commenter Bert Harris requested waiver of privilege to discuss letters he had sent to the town. After town attorney guidance that privilege could be waived only by council action, a motion to waive the privilege on the identified letters was moved, seconded and passed by roll call.
Finally, the council authorized the mayor to execute contingency-fee engagement documents with outside counsel (Bartlett Law Offices PC and Grossmann & Kelly LLP) to file and preserve the town's claim in the 3M and DuPont public-water-system settlements (MDL No. 2:18-MN-2873) on a one-third contingency basis, subject to town-attorney review. The firms will run testing and collect data at no upfront cost to the town; the council recorded a roll-call vote approving the engagement.
