Orrville council adopts emergency resolutions for a new utility truck, coal contract, culvert repairs and updates nuisance law

At its Nov. 4 meeting the Orrville City Council unanimously adopted several emergency resolutions to replace a failed distribution truck, authorize coal/ash and annual utility contracts, expedite East Hostetler culvert repairs, and amended the citys criminal-activity nuisance ordinance to cover entire residential properties.
Orrville City Council on Nov. 4 unanimously approved a package of emergency resolutions authorizing several immediate purchases and contracts and adopted an amendment to the citys nuisance ordinance.
The council suspended the usual three-reading requirement and adopted Resolution 32-24 to permit the Director of Utilities to buy a 40-foot distribution bucket truck without bidding after the city determined an older truck failed an electrical test and repairs would exceed the vehicles value. Officials said funds are available in the capital budget and the old truck will be offered for resale or trade-in.
Council also approved Resolution 33-24 to authorize the Public Utilities Board of Control to enter into a five-year coal supply and ash disposal contract without bidding, citing that the current supplier contract is ending (the present contract has a two-year extension option) and regional alternatives are limited. Staff said proposals are expected by the end of the month and that the current contract expires Dec. 1.
Resolution 34-24 enables the Board of Control to enter into one-year contracts without bidding for various services and supplies that could exceed $100,000 during 2025. The legislation was described as substantially identical to last years authorization and was adopted as an emergency.
For infrastructure, Resolution 36-24 separates the East Hostetler culvert repair from the larger Hostetler road project because the road contractor does not perform culvert work. City staff said the culvert deteriorated after August flooding and the goal is to complete the culvert work by Thanksgiving; council approved obtaining quotes and entering contracts as an emergency measure.
Council adopted Ordinance F-24, amending City of Orrville Codified Ordinance §521.13 (Criminal Activity Nuisance) by replacing the term "dwelling unit" with "residential property," expanding the ordinances scope to include exterior property such as yards. "This was the single most useful tool in their toolbox with regards to continual issues at a property," Chief Birkbeck said of the nuisance ordinance, noting the change clarifies enforcement outside the interior of a unit.
All motions to suspend the three-reading rule and to adopt the listed measures passed by unanimous voice or roll-call votes.
The council set its next regular meeting for Monday, Nov. 18, 2024, and scheduled follow-up committee work on some of the items that require additional detail or negotiation.
