Commission continues LA Hearne landscaping review after stormwater violation noted

The King City Planning Commission on June 2, 2026, continued consideration of the LA Hearne Landscaping Plan Review (Case LPR25-000007) after staff reported stormwater violations at the project site on East San Antonio Drive and recommended referral to the City Engineer for citation.
Planning Technician Esmeralda Alvarez introduced the continued item and said staff had screened the proposal under the California Environmental Quality Act and determined it may be exempt under CEQA Guidelines Section 15061(b)(3), the general rule that CEQA applies only to projects with potential for significant environmental effects. The item involves review of substantial conformance with Condition of Approval No. 6 from Conditional Use Permit Case No. CUP24-000008.
Chief Building Official Mark McClain said he had driven by the property and observed wood "back in the gutter." McClain said staff would forward the stormwater violations to the City Engineer to begin the stormwater citation process. “Staff cannot authorize that because it's a violation of the ordinance and mandate from the State,” McClain said, adding that the applicant must comply or face citation.
Applicant Ivy Hearne said she had been working on the site and believed "wood can be used to go in and out as long as it was removed when not in use," and provided updates on progress. McClain responded that temporary use in that manner would still violate the ordinance and the state requirement.
Commissioner Teri Storelli asked whether a checklist existed for post-CUP compliance. McClain said the applicant received a checklist for the CUP; Alvarez clarified there is no separate checklist after a CUP but applicants sign conditions of approval that define required compliance steps.
After discussion, Commissioner Storelli moved to continue the item off the calendar; Commissioner Margarita Lopez seconded. The motion carried 4-0. The commission did not set a new hearing date; staff will proceed with forwarding the stormwater violation to the City Engineer for possible citation and will bring any further compliance items back to the commission as required.
The project is identified as LA Hearne Landscaping Plan Review, APN 026-521-008-000, and is associated with Landscaping Plan Review Permit Case No. LPR25-000007 and Conditional Use Permit Case No. CUP24-000008.
