The Town of Vienna Planning Board on Aug. 21 voted to revise condition 1 of SUP2025-03 for the Primal Tee Shop (3088 Pine Rd) to permit only exterior lighting required by the Building Code of New York State.
Secretary Kathy Pavelock had distributed the Notice of Determination and a letter from the Codes/Zoning Officer noting that the original condition — "The new building addition used for manufacturing shall have no outside lighting" — directly conflicted with the Building Code. The board said its intent was not to prohibit all building lighting.
Tammy Crawford moved to replace the condition with: "The new building addition used for manufacturing shall have no outside lighting except for lighting required by the Building Code of New York State." Martha Link seconded the motion. Recorded poll votes in the minutes were: Orrin MacMurray – Absent; Bill Shaughnessy – Aye; Martha Link – Aye; Tammy Crawford – Aye; Dave Carpenter – Absent; Miranda Ward – Aye; Vacancy – n/a. The motion carried as recorded.
The secretary will prepare an updated Notice of Determination for chairman Orrin MacMurray to approve and distribute.
