Council votes down motion to submit notice of intent to dissolve Manaway Justice Court

Mantua — The Town Council on June 18 considered whether to submit a notice of intent to the Judicial Council to dissolve the Manaway Justice Court but voted against submitting the notice by the July 1 deadline.

Cheryl (speaker 2), who introduced the agenda item, summarized the town's options: dissolve the court, enter an interlocal agreement with the county, or pursue hybrid arrangements. She told the council a notice filed by July 1 would allow records and jurisdictional changes to take effect sooner; if the town misses that deadline, dissolution could be delayed for a year.

Cheryl said the analysis showed the court's caseload has fallen sharply — "we've seen a decrease in the case submission over the last 3 years by 65%" — and that a significant share of defendants are nonresidents. She described two costed options: an interlocal agreement that requires a yearly fee but could split fine revenue 50/50, and dissolving the court, after which the town would get none of the fines and forfeitures currently associated with its local court.

Council members questioned both financial calculations and nonfinancial values. One councilor noted that local justice officials "know the people" and provide community-level responses that may be lost if cases move to the county. Others warned the court had been operating at a loss and recommended monitoring the next fiscal year before making a structural change. Councilors also requested more detailed accounting to reconcile apparent discrepancies between reported fines and forfeitures and the amounts shown in the town budget.

A motion to submit a notice of intent to dissolve the Manaway Justice Court by July 1 was moved and seconded but failed in the vote; the mayor announced "Motion does not pass." Councilors agreed to continue monitoring court receipts and expenditures and to revisit the matter with additional financial detail.
