Franklin County Legislature accepts hearing officer report and terminates employee

The Franklin County Legislature accepted a hearing officer's report and recommendation on Dec. 28 and terminated an employee effective that same day after a Section 75 disciplinary proceeding, the Legislature said.
The report, dated Dec. 21, followed a full hearing held Nov. 14 on charges served in September 2018. Because the County Sheriff was directly involved in testimony and in the prosecution of the case, the Legislature said the Sheriff should not issue the final decision; the Legislature, as co-employer, made the final determination.
Chairman Donald Dabiew convened the special meeting at 10:05 a.m. and the Legislature unanimously adopted the hearing officer’s recommendation to terminate the employee. The resolution directed Chairman Dabiew to issue a Notice of Determination to the employee and counsel. The hearing officer’s report and transcript of the proceedings were placed in the record and reviewed by members prior to the vote.
The meeting record shows the action was taken under the provisions of Civil Service Law Section 75; the Legislature’s resolution does not disclose the identity of the employee in the public minutes or summarize the underlying charges. The county indicated the termination was effective Dec. 28, 2018 and that the required notice would be issued.
The special meeting adjourned at 10:20 a.m.
