Franklin County Legislature approves 15-year PILOT for 4.53 MW community solar project; one abstention

The Franklin County Legislature on Sept. 5 voted to consent to a proposed payment-in-lieu-of-tax (PILOT) arrangement for a community solar project planned by OYA State Route 122 LLC on roughly 144 acres at 1436 State Route 122 in the Town of Constable. The resolution, offered by the Economic Development Committee, passed with six ayes and one abstention (Legislator Dumas).
Under the approved PILOT structure the County will freeze a "Base Valuation" at a full market value of $158,590 for the land and assess a supplemental per‑MWAC payment. The agreement specifies a $5,500 per MWAC charge based on the project's 4.53 MWAC capacity (with annual escalation of 2 percent) in addition to the base valuation payment. The resolution documents a 15‑year abatement term; after the fifteenth PILOT year the facility will be subject to full taxation by affected jurisdictions.
The project description in the agency materials identifies the facility as a 4.53 MWAC/6.8 MWDC photovoltaic (PV) community solar electrical generation system, with associated foundations, inverters, transformers, interconnection wiring, sitework, landscaping and fencing. The PILOT approval authorized a deviation from the Industrial Development Agency's Uniform Tax Exemption Policy to allow fixed-dollar per‑MWAC payments and the 15‑year schedule.
Legislators approved the consent to the Agency's PILOT terms at a roll-call vote; the resolution record shows five named sponsor-legislators and the roll-call outcome noted one abstention. The resolution requires annual certification by the company of the project's MWAC capacity and provides that any future capacity increases will raise the per‑MWAC payments accordingly. The text of the agreement also lists an itemized per‑year escalation schedule attached as Exhibit A.
