On May 14, 2026, the Town of North Wilkesboro Planning Board voted unanimously to approve proposed text amendments to Articles 3.2, 3.4 and 3.7 of the town Zoning Ordinance that remove waiting periods for withdrawn or denied development applications and eliminate up-front site-plan requirements for most Conditional District rezonings.
Planning and Inspections Director Joseph Kamperman, who presented the proposal during a public hearing, said the waiting-period change was prompted by state law. "The reason for the request by the Town of North Wilkesboro for the text amendment was to come into compliance with NC General Statute 160D-601 to remove waiting periods for withdrawn or denied applications," Kamperman said. He added that the town would continue to charge application fees for repeat submissions.
Town Attorney Victoria Brooks told the board that conditions negotiated as part of a Conditional District "run with the land even if the land was sold at a future date," and she said removing an up-front, engineer-certified site plan requirement could reduce the upfront cost for applicants while preserving protections for neighboring properties through conditions.
Board members discussed likely effects. Vice Chair Kenneth Turner and Commissioner Michael Parsons said the change was intended to make pursuing Conditional Districts more developer-friendly; Mr. Murphy said he expected to see more Conditional District proposals. David Jones cautioned that negotiated conditions could, in practice, restrict an applicant more than a straight rezoning.
Ron Myers moved "to adopt the proposed Consistency Statement dated May 14th, 2026, contained in the agenda materials and to approve the proposed zoning text amendment to the Zoning Ordinance to remove waiting periods for withdrawn or denied applications and site plan requirements for Conditional District / proposals-Article III. Administration, 3.2 The Boards, 3.4 Special Use Permits, & 3.7 Amendments." Vice Chair Turner seconded; the motion passed 8-0.
The Planning Board also found the amendment consistent with the town Comprehensive Plan, citing Goal B.1 (flexible land use controls) and Goal B.2 (maximize redevelopment potential), and said the changes would bring the zoning text into compliance with NC General Statute 160D-601.
Next steps: the Planning Board’s action records a recommendation and consistency finding; the amendment will proceed to the Board of Commissioners for final action under the town’s ordinance process.
