Poseyville council unanimously approves disannexation of 19.2 acres

Council President Justin Rutledge presided over a Sept. 17, 2024 public hearing in Poseyville that ended with the council unanimously approving an ordinance to disannex 19.2 acres of land owned by William H. Bender from the town limits.
The council adopted Ordinance No. 2024-09-17-01 after first voting to suspend the normal two-reading rule for ordinances. Council Member Randy Rankin moved to suspend the rules; Council Member Michael Baehl seconded. The roll-call vote recorded Justin Rutledge, Michael Baehl and Randy Rankin as voting yes.
The ordinance was then moved by Rankin and seconded by Baehl and passed on a unanimous roll-call vote: Rutledge (yes), Baehl (yes), Rankin (yes). The ordinance approves the disannexation of a 19.2-acre portion of Mr. Bender’s original tract that county tax records list as inside the town limits.
President Rutledge told the council that Posey County Auditor records indicate 19.2 acres of Mr. Bender's original tract are currently within Poseyville’s limits and are the subject of the disannexation petition. He also said the town expects Hometown Ventures Group, LLC to seek annexation of 32.75 acres after completing required area plan steps.
Petitioner William H. Bender addressed the council during the hearing and clarified his role, saying he attended “as the petitioner as stated in the third WHEREAS in Ordinance 2024-09-17-01” and that he was not present as the town attorney because that “would be construed as a conflict of interest.”
No members of the public offered comments during the hearing. The council scheduled its next regular meeting for Oct. 8, 2024, at 5:00 PM; that meeting will include a Budget Public Hearing. After completing business the council adjourned at 3:20 PM.
Ordinance No. 2024-09-17-01 is made part of the meeting record by incorporation.
