Board pauses review of subdivision and zoning language after debate on 'nonconforming' classification

The town board reviewed proposed changes to its subdivision and zoning chapter and discussed the interpretation of nonconforming properties under Section 156.050. One speaker summarized the section as treating certain lots or structures as "grandfathered" nonconforming uses that existed before the adoption of newer language.

"If you're looking at 156.050 essentially these are going to be that were sort of grandfathered in—they were nonconforming based on this language but they existed prior to the adoption of this language," the speaker said while outlining that the zoning board typically handles interpretation and enforcement questions under the chapter. The discussion focused on whether prior agreements or past commission decisions affect current interpretation and the town board's duty to consider amendments.

Members noted the chapter is dense and important and agreed there may not be many substantive changes. After deliberation, the board agreed to pause the review at page 64 (Section 156.085) and finish the remainder at the next meeting, with members asked to reread the chapter multiple times before reconvening.

No formal amendments or votes were taken on the zoning chapter during the session; the board scheduled follow-up review for the next meeting.
