Courtney (staff presenter, speaker S2) informed the commission that contractor S J Lewis has filed suit seeking $120,000,000 in damages related to three contracts with a combined value the presenter said is roughly $105,000,000.
"SJ Lewis is suing for $120,000,000 in damages on the 3 contracts with a total value of approximately 105,000,000," Courtney said. She told the commission that discovery is advancing and depositions will begin the following week; utility staff and consultants will take depositions of S J Lewis employees as part of preparation.
Courtney said the utility sent a letter asking S J Lewis for a schedule to complete outstanding restoration items by Sept. 5; after no response, the utility plans to proceed with restoration work and increase the amount the contractor will owe as a result. Staff also said they are investigating making a claim on the contractor’s performance bond to complete the work.
Commissioners were updated that litigation and discovery are active; the meeting transcript includes no settlement or resolution on these claims and no court dates beyond depositions were provided in the public meeting.
