Council moves Spring Valley annexation to election, authorizes agreement for city water and improvements

Boulder City Council on June 18 unanimously approved Resolution 1381, finding that a petition to annex about 43.194 acres in the Spring Valley Estates subdivision meets state requirements and directing that an election be called. Council also authorized the city manager to execute an agreement with the Spring Valley Mutual Water Association to govern annexation and the transition of municipal services.

Planning staff presented the petition and recommended initial zoning of Residential Estate (RE) for the 36 lots included in the petition. Chandler Van Schaack, principal planner, said the main driver is access to municipal water and improved fire protection: "The primary purpose behind this petition for annexation is the petitioners' request to have the Spring Valley neighborhood connected to the city's municipal water system," he said.

The terms and conditions discussed include construction of water mains and hydrants, an off‑site booster pump station, roadway upgrades to improve emergency access, easement dedications, and a requirement that properties connect to city water when the system is complete. Staff described a financing approach using a local improvement district (LID) that would require property owners to pay 100% of preliminary cost estimates with up to a 15% contingency and offered options to pay assessments in full or in 30‑year installments.

Applicant Carolyn Stefl, representing Spring Valley Mutual Water Association, told the council that residents had supported the petition and that the proposal was designed to address low pressure and inadequate flow for firefighting: "We're looking at millions of dollars of improvements that have to be financed by these 36 homes," she said, arguing the LID and payment plans made the project feasible for homeowners.

City utilities staff said the mutual association's existing water rights are of limited quantity and location and are not likely to be acquired by the city; Deputy Director Chris Deville said the rights have "very little value for us financially or practically." The city manager's office and applicants said they are pursuing a Department of Local Affairs (DOLA) grant; staff materials alternately referenced a "$1 DOLA grant" while applicant remarks noted a $1 million DOLA grant award and an extension request that would be needed to preserve the funding.

Property owners and board members at the public hearing pressed council on cost‑allocation methodology (arguing for allocation based on net buildable area rather than gross acreage), the valuation and sale of a small parcel containing the pump house, and the timing of the annexation election. Applicants asked the council to consider waiving the 90‑day special‑election prohibition to preserve the DOLA grant; the city attorney and staff advised that amending local election rules or passing a one‑time ordinance would be legally and administratively difficult on the short timeline.

The resolution was adopted by roll call with the full council voting yes. The authorization for the city manager to execute the annexation agreement also passed unanimously. If the annexation proceeds, council and applicants said they aim to form the LID, secure funding and permits, and begin construction of the improvements in the following months. The annexation election will be held per the timeline determined in the resolution and applicable election rules.
