Jason (staff member) reported that the separate CCMG 2024-1 project, contracted to E & B, has a completion deadline of May 5, 2025, and that the contract includes a stated liquidated-damage provision of $1,000 per day for delays beyond that date. Council discussion focused on communicating with the contractor and engineer—identified in the minutes as USI (engineer) and Brooks (contractor) for the earlier project—to determine the origin of the DeVoe Drive pavement issue before releasing retainage.
The council tabled the retainage matter pending a final determination of fault. No vote to release funds or close the project occurred at the meeting. Council members noted that the unresolved issue affects the town’s ability to apply for new CCMG projects while the current project remains open.
Next steps recorded include staff follow-up with the engineer and contractor to resolve the DeVoe Drive issue and monitoring E & B’s progress on the CCMG 2024-1 project ahead of the May 5 deadline.
