Mobile Planning Commission approves findings for petition 2601 after correcting municipal code citation

The Mobile Planning Commission approved a set of findings of fact for petition 2601 at a special meeting and amended the draft to correct a transposed municipal code citation before forwarding the record to the Board of Works.

A committee member moved to approve the commission’s findings of fact for petition 2601 and the motion was seconded and discussed. Heather, a staff member who presented the item, told the commission that the Board of Works requires written findings and the February minutes so it can consider both the appellants’ statements and the commission’s rationale when it issues an opinion on pending appeals. She said the findings were within the commission’s discretion and that edits could expedite the Board of Works’ review.

During discussion the clerk identified a typographical error in the draft findings. “It should read section 150.104 and not 140,” the clerk said, noting the citation had been transposed in paragraph three. The mover amended the motion to incorporate the corrected citation, the amendment was seconded, and the commission voted on the amended motion.

The chair called for the vote; several commissioners voiced aye and one no was recorded in the transcript. The clerk recommended a formal roll call to ensure the official tally was entered in the record. After the vote the chair stated that the motion carried and the commission concluded the business on the special agenda.

The corrected findings and the February minutes will be part of the record transmitted to the Board of Works for its consideration of the appeal(s). No additional actions, deadlines, or conditions were read into the record during the special meeting.
