Athens-Clarke County commissioners on May 5 adopted ordinances dissolving an existing planned development at 1165 Oglethorpe Avenue and rezoning the roughly 3.85-acre parcel from Commercial-Neighborhood (C-N) Planned Development to RM-1 Mixed-Density Residential, with specific conditions.
The commission’s motion, made by Commissioner Fisher and seconded by Commissioner Link, passed by unanimous vote. Conditions attached to the rezoning include restricting the development’s units to residents age 55 or older for 30 years after certificates of occupancy; leasing all units to households earning less than 80% of Area Median Income (AMI) for 30 years; limiting building height to two stories; providing a minimum 15-foot landscape buffer and at least a six-foot opaque fence along the subject parcel’s western lot line; and, if a second entrance onto Landor Drive is required, restricting that entrance to emergency access only. The ordinance also dissolves prior ordinances and master site plans associated with the original planned development.
Petitioner David Ellison and commenters Justin Sanders and Susan Brooks appeared in the public hearing; Brooks requested that any exit onto Landor Drive be for emergency use only, which the commission incorporated as an amendment. The adopted ordinance and conditions are on file in the Athens-Clarke County Planning Department.
