The Yarmouth Port Conservation Commission voted on a range of permit and enforcement matters during its June 4 meeting, approving certificates of compliance and orders of conditions, issuing a fine, and continuing several complex applications for revision.
Key outcomes included approval of a Negative Two determination for 39 Doherty Lane; issuance of a certificate of compliance for 11 Cape Isle Drive with ongoing conditions; issuance of an order of conditions for the seasonal dock at 37 Indian Memorial Drive with special conditions; and issuance of an order of conditions for an inground pool at 0 Baldwin Lane contingent on a revised patio plan. The Commission also ratified an enforcement order and set deadlines for required planting plans and removals in several violation matters.
The Commission voted 6-0 to approve previously drafted minutes at the meeting’s start. A $300 fine was withdrawn for Great Island Realty Trust and instead issued to Great Island Associates after discussion of lease responsibilities. In the matter of SE83-75 (703 Route 28), the Commission voted to issue a certificate of compliance pending immediate cleanup of potentially hazardous materials found on site.
Several applications were continued to allow applicants to submit revised plans: SE83-2270 (Channel Point, invasive species plan and planting plugs) was continued to September 17, 2026; SE83-2531 (703 Route 28 redevelopment) was continued to June 18, 2026 for requested revisions including an invasive species management plan and soil testing; SE83-2534 (14 Compass Drive seawall) was continued to July 12, 2026 for mitigation and fill details; and SE83-2538 (166 and 172 Blue Rock Road bulkhead) was continued to July 16, 2026 with peer review planned.
The Commission also ordered removal of unpermitted patio and walkway at 7 Cape Isles Drive by July 10, 2026 under a violation notice, and ratified deadlines for replacement plantings and plan submittal in an enforcement case involving unpermitted work and a firepit. The meeting closed after votes to reappoint Chair David Bernstein and Commissioner Jack Frost and to appoint Commissioner Frost as secretary effective July 1, 2026.
