Operations committee recommends Green Space-funded purchase of 6 acres near Lady's Island Middle School for full-board consideration

A county Green Space Program representative told the Beaufort County School District operations committee that the program has recommended continuing due diligence and negotiating an acquisition of a six-acre parcel contiguous to Lady's Island Middle School, with grant funding to support the purchase.

“We are an application driven program … we are in that due diligence phase and we have a green space advisory committee recommendation that allows us to continue working to negotiate with the applicant,” Mark Davis said, summarizing the program's role and process. Staff confirmed the application requests funding up to $2,250,000 for the parcel.

Why it matters: the applicants and Green Space staff say the owners prefer a conservation outcome and that the parcel has drawn commercial interest including developers. Ethan James, the real-estate representative for the landowners, told the committee the owners had received multiple offers and have chosen to pursue preservation: “For us to have the opportunity to preserve this amount of land in an area that is consecutively getting $500,000 per acre along this strip and corridor … by them offering it at this value … it just, you know, it's something that they would like to see.”

Board members pressed staff on why title would be placed with the school district rather than the county or a municipality, citing liability and upkeep concerns if the school took ownership. Staff said the county would fund the acquisition as a grant; the school district would hold title and the grant instruments and recorded covenants would limit uses and protect the land in perpetuity. “This would be funded… we are funding the project. You all are the purchasers,” Mark Davis said, describing the legal structure staff plans to use.

What happened: after prolonged discussion about liability, uses, and community interest, a committee member moved to recommend the Green Space application to the full board and to authorize the superintendent to negotiate contract terms and bring a contract back for board approval. The motion was seconded and approved by voice vote. Staff said the item will be added to the board agenda for the next Tuesday meeting.

What remains unresolved: the exact negotiated purchase price, specific covenant language and maintenance arrangements are to be determined during staff negotiations; staff said the Green Space advisory committee had authorized negotiation up to the $2,250,000 application amount but final contract terms will return to the full board for approval.
