The Hobart Board of Public Works and Safety voted 3-0 on March 18 to affirm the Hobart Plan Commission's decision granting a fill permit in Docket 26-01, which concerns property south of 61st Avenue, east of Colorado Street and north of 69th Avenue. Mayor Joshaua Huddlestun presided; board members Maria Galka and Deborah A. Longer voted in favor.
Attorney Dave Westland told the board it could affirm, modify or reverse the Plan Commission decision under Hobart Municipal Code —7150.104 and that the board's decision would be communicated in writing to each person who filed an appeal. After reviewing the Plan Commission record and the written findings, the board affirmed the permit for all consolidated appeals by a unanimous vote.
The docket listed multiple appellants, several of whom did not appear. Appellants who appeared and presented testimony or written evidence included Elizabeth Gagliardi (with Dominic Gagliardi), Jennifer McQuade (who also represented Kermit Deel in one entry), Barbara Koteles, Dana Triber, Angelita Soriano and Susan Thompson. Attorney Eric Morris of Morris Law Group appeared and presented for Stone Meadow LLC and for Ms. Mikolics on the record. Other appellants listed in the docket—such as Maria and Tony McWhorter, Matt Turner, Erin Yanz, Joseph Conn, Sally and Dick Pavel, Vance Thompson and Albina Venegas-Roman—were recorded as not appearing.
The board recorded the vote as three in favor and none opposed and directed that the decision be communicated in writing to the appellants. The board did not alter the Plan Commission findings on the permit and took no additional action on conditions beyond what appears in the Plan Commission record.
What happens next: the board's written notices will be sent to each appellant. The record before the board and the Plan Commission's written findings remain the operative documents concerning the permit.
