Wilbur Planning Commission approves findings for petition 2601 after correcting code citation

The Wilbur Planning Commission voted to approve findings of fact for petition 2601 and forwarded the document to the Board of Works, the commission said at a special meeting.

Heather, a staff member who addressed the commission, said several appeals have been filed and that "the Board of Works must respond to those in writing," meaning the Board needs the commission's written findings when it considers the appeals. A separate staff member told commissioners the Board also needs the commission's February meeting minutes on file before issuing its opinion.

During discussion a staff member identified a scrivener's error in the draft findings: a code citation printed as "150.14" should read "150.104." The commission amended the motion on the floor to include that correction before voting. As the staff member said on the record, "It should read section 150.104 and not 140." The amendment was incorporated into the final motion.

A committee member moved to approve the findings as amended; the motion was seconded and passed. The roll call recorded affirmative votes from named commissioners including Schultz, Perry, Gallagher, Hanna and Metz; the transcript indicates one commissioner voted no but does not name that voter. The chair declared the motion carried and the findings approved.

The approved findings and the February minutes will be provided to the Board of Works, which will hear the outstanding appeals at a future meeting. The commission adjourned after completing the special-meeting agenda.
